To the Commissioner for Trademarks:

Application serial no. 88716487  (Stylized and/or with Design, see http://tmng-al.uspto.gov /resting2/api/img/8871648 7/large) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The reason for the nonfinal office letter was that the specimens submitted do not show use in commerce. "Specifically, applicant identifies its services as 'teaching at elementary schools.' It is not clear from applicant?s specimen, however, that applicant offers any academics regarding elementary schools. The updated specimen displays the mark in use on the school's website near a description of A.E. Phillips Laboratory School, which is described as "a K-8 school...known for its strong academic focus and innovative teaching strategies." Therefore, we respectfully request the mark be submitted for registration.

CLASSIFICATION AND LISTING OF GOODS/SERVICES

Filing Basis: Section 1(a), Use in Commerce: The applicant is using the mark in commerce, or the applicant's related company or licensee is using the mark in commerce, on or in connection with the identified goods and/or services. 15 U.S.C. Section 1051(a), as amended. The mark was first used at least as early as 05/23/2019 and first used in commerce at least as early as 05/23/2019 , and is now in use in such commerce.
