USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Michelle Kahn on December 11, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

DESCRIPTION OF MARK

 

The following statements describing color in the mark replace the current description of color in the mark of record:

 

The colors yellow, green, blue, orange, white and black are claimed as a feature of the mark.

 

The mark consists of the wording “ALL” in yellow and outlined in black and then white above the wording “ACCESS” in a gradient of light blue and dark blue and outlined in white with a curved line extending from the end of the last “S” around the back of the word “ACCESS” in the colors, dark blue, light blue, orange, green, and white and ending in a blue and white rectangular card containing the wording “ALL ACCESS” in dark blue, all on a background of green, yellow, and blue containing a few white lens flares and white rays.
