Dear Claudia:

 

I am the attorney from the United States Patent and Trademark Office assigned to examine the above-referenced U.S. Trademark Application. 

 

I have searched the Office’s database of registered and pending marks and have found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).  However, the identification of goods must be clarified because it is indefinite and overbroad.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.03(d), 1402.11(a).

 

Specifically, applicant must clarify whether the format of all the identified computer programs is downloadable, recorded, or online non-downloadable.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.03(d), 1402.11(a).  Downloadable and recorded goods are in International Class 9, whereas providing their temporary, online non-downloadable use is a service in International Class 42; except for non-downloadable game software provided online or for temporary use, which is classified in International Class 41.  See TMEP §§1402.03(d), 1402.11(a)(xii).

 

In addition, for the wording “computer programs designed to estimate costs and health impact of various gestational diabetes mellitus screening choices”, applicant must further clarify the purpose and/or function of the computer programs.   See TMEP §1402.03(d).  The USPTO requires such specificity in order for a trademark examining attorney to examine the application properly and make appropriate decisions concerning possible conflicts between the applicant’s mark and other marks.  See In re N.A.D. Inc., 57 USPQ2d 1872, 1874 (TTAB 2000); TMEP §1402.03(d).

 

The following amendment is suggested, if accurate:

 

Class 9:                Downloadable computer programs for data processing; downloadable computer programs designed to estimate costs and health impact of various gestational diabetes mellitus medical screening choices.

With your authorization, I can enter the suggested amendment myself by Examiner’s Amendment.  Entering the amendment in this manner would eliminate the need for issuance of a formal Office Action and for filing a formal Response.
