USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Lisa Ferrari on January 13, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

 

Identification of Goods and Services Amendment

 

The identification of goods and services is amended to read as follows:

 

Class 6:  Sculptures and works of art made of non-precious metals.

 

Class 9:  Sunglasses; cases for sunglasses.

 

Class 14:  Works of art of precious metals and their alloys; jewelry; pins being jewelry; precious and semi-precious stones for jewelry; horological and chronometric instruments, namely, watches and clocks.

 

Class 16:  Paper and cardboard; posters; drawings; prints; works of art made of paper and/or cardboard; printed books in the field of art; greeting cards; postcards; bookbinding material; photographs; stationery; stationery, namely, postcards and greeting cards; office requisites, except furniture, namely, pens, pencils, paper and notebooks; artists' materials, namely, pens, pencils, paper and notebooks; drawing materials and materials for artists, namely, molds for modeling clays, painting sets, spatulas, water color saucers, artists' pens, pencils, pastels, brushes and canvas panels; paintbrushes; printed instructional, educational and teaching materials in the field of art; plastic sheets, films and bags for wrapping and packaging.

Class 20:  Acceptable.

 

Class 25:  Acceptable.

 

Class 28:  Games, namely, puzzles, tabletop games, board games, parlor games, and playing cards; toys, namely, soft sculpture toys and plush toys; toy figures; collectable toy figures; toy vehicle play sets and accessories therefor; toy action figure play sets and accessories therefor; doll play sets and accessories therefor; play sets for creating decorative design and art and accessories therefor; inflatable toys; inflatable pool toys; inflatable dolls and playthings; arcade video game machines, video game consoles, hand-held video game units; gymnastic and sporting articles, namely, footballs, baseballs, basketballs, soccer balls, racquet balls, racquets, bats, golf bags, golf balls, boards used in the practice of water sports, rollerblades, roller skates, skateboards; Christmas tree decorations.
