Miscellaneous Statement
The Examiner requested a clarification as to the type of data (associated with mechanical devices in commercial or industrial settings) that is collected and analyzed. The Examiner suggested either
"business" data in class 35, or "financial" data in class 36. However, the data collected is not particularly well described by either of those options. Rather, the data relates to the operation of
such machines (e.g., their performance, functionality, tolerances, capacity, activity, etc.) as collected by various sensors associated with the machines (and mentioned in Applicant's class 42
services). Applicant therefore proposes the word "operational" instead. If the Examiner needs further clarification, Applicant is happy to provide same. With respect to software in class 42,
Applicant has made the same clarification as above. However, the Examiner also requested clarification as to the field in which such services are provided to commercial or industrial installations.
Applicant notes that its class 42 software and apps are field agnostic. Any field that employs industrial or commercial machines is of relevance. As non-limiting examples, any field that includes
manufacturing or chemical processing or transportation or construction or the like, would all be potentially relevant. Applicant's software uses sensors to monitor various conditions of such
machinery as desired (e.g., vibration, movement, temperature, actuation, power consumption, or the like). As such, limiting Applicant's services beyond "in the field of commercial or industrial
installations" would be inappropriate.
