USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.

The purpose of this examiner’s amendment is to correct the inadvertent typographical error in identifying Ms. Simmons’ name in the examiner’s amendment issued earlier today.

The wording “pharmaceutical preparations, namely, anticholinergics as adjuncts in anesthesia and gastrointestinal ailments” is amended to “Pharmaceutical preparations, namely, anticholinergics for use as adjunct drugs in connection with anesthesia and the treatment of gastrointestinal ailments”
The amended identification of foods for Class 5 reads:
