EXAMINER’S AMENDMENT
Issue date: December 26, 2019
USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. As agreed to by applicant’s attorney Weitao Chen on December 26, 2019 by telephone call, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id.
DESCRIPTION OF THE MARK
The following description of the mark replaces the current description of record:
The mark consists of stylized images of two gods from Japanese mythology. On the right is the god of wind holding a sack of wind over his head with ribbons flowing around him. On the left is the god of lightning and thunderstorm holding drumsticks and surrounded by a rope with tiny Japanese drums attached and ribbons flowing around him. Between the two gods are four stylized vertically-arranged Chinese characters. Centered below the aforesaid image is the wording “FUJIN & RAIJIN”.
See 37 C.F.R. §§2.37, 2.72; TMEP §§808 et seq.
TRANSLITERATION / TRANSLATION STATEMENT
The following transliteration/translation statement replaces the current one of record:
The non-Latin characters in the mark transliterate to “FENG SHEN LEI SHEN” and this means the god of wind and the god of lightning and thunderstorm in English.
37 C.F.R. §§2.32(a)(10), 2.61(b); TMEP §§809, 809.03.
