SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION – CLASSES 41 & 42

 

Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 2,040,691, 2,076,457, and 4,496,049.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the attached registrations.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods and services of the parties.  See 15 U.S.C. §1052(d).  Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).  In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017).  Only those factors that are “relevant and of record” need be considered.  M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018). 

 

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis:  (1) the similarities between the compared marks and (2) the relatedness of the compared goods and services.  See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

 

SIMILARITIES BETWEEN THE MARKS

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).  “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.”  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).

 

Applicant’s applied-for marks is the stylized wording “YAHOO!” for, in relevant part, “Education; providing of training; entertainment; sporting and cultural activities; entertainment services in the nature of providing non-downloadable online games and contests provided via computer networks; providing information relating to electronic and computer games; booking of entertainment; lottery services; providing non-downloadable multimedia entertainment content, namely, games and ongoing shows featuring music and sports via computer networks; ongoing entertainment programs broadcast via radio, television, cellular communication, wireless communication, the internet, electronic communications networks, and computer networks in the fields of current events, news, commentary, weather, sports, entertainment, fashion, finance, music, inspiration, health, lifestyle, travel, parenting, science, technology, culture, and wellness; production of music video programs for broadcast on computer networks; production of video programs for broadcast on computer networks; entertainment services, namely, providing information, statistics and commentary in the fields of education, entertainment, finance, current event news, sports betting, and sports for children and adults via computer networks; online photography services; providing non-downloadable prerecorded music, information in the field of music, and commentary and articles about music, all via computer networks; providing information regarding photography; entertainment services, namely, providing podcasts in the fields of news, commentary, weather, sports, entertainment, fashion, finance, music, inspiration, health, lifestyle, travel, parenting, science, technology, culture, and wellness; Registrant’s marks are stylized word-design marks featuring the wording “YAHOO!”, “YAHOO!”, and “YAHOO! ON THE ROAD” for, respectively, “computer services, namely, creating indexes of information, sites, and other resources available on computer networks; searching and retrieving information, sites, and other resources available on computer networks for others; providing an online link to news, weather, sports, current events, and reference materials” in International Class 42; “magazines regarding computer networks and searching and retrieving information, sites, and other resources on computer networks” in International Class 16; “Promoting the concerts of others” in International Class 35; and “Arranging and conducting of concerts; concert booking; entertainment, namely, live music concerts” in International Class 41.

 

When comparing marks, “[t]he proper test is not a side-by-side comparison of the marks, but instead whether the marks are sufficiently similar in terms of their commercial impression such that [consumers] who encounter the marks would be likely to assume a connection between the parties.”  Cai v. Diamond Hong, Inc., __ F.3d __, 127 USPQ2d 1797, 1801 (Fed. Cir. 2018) (quoting Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012)); TMEP §1207.01(b).  The proper focus is on the recollection of the average purchaser, who retains a general rather than specific impression of trademarks.  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re St. Helena Hosp., 774 F.3d 747, 750-51, 113 USPQ2d 1082, 1085 (Fed. Cir. 2014); Geigy Chem. Corp. v. Atlas Chem. Indus., Inc., 438 F.2d 1005, 1007, 169 USPQ 39, 40 (CCPA 1971)); TMEP §1207.01(b).

 

Marks may be confusingly similar in appearance where similar terms or phrases or similar parts of terms or phrases appear in the compared marks and create a similar overall commercial impression.  See Crocker Nat’l Bank v. Canadian Imperial Bank of Commerce, 228 USPQ 689, 690-91 (TTAB 1986), aff’d sub nom. Canadian Imperial Bank of Commerce v. Wells Fargo Bank, Nat’l Ass’n, 811 F.2d 1490, 1495, 1 USPQ2d 1813, 1817 (Fed. Cir. 1987) (finding COMMCASH and COMMUNICASH confusingly similar); In re Corning Glass Works, 229 USPQ 65, 66 (TTAB 1985) (finding CONFIRM and CONFIRMCELLS confusingly similar); In re Pellerin Milnor Corp., 221 USPQ 558, 560 (TTAB 1983) (finding MILTRON and MILLTRONICS confusingly similar); TMEP §1207.01(b)(ii)-(iii).  Here, applicant’s and registrant’s marks share the distinctive term “YAHOO”.

 

Based on the foregoing, applicant’s applied-for and registrant’s marks convey similar commercial impressions and are sufficiently similar to find a likelihood of confusion.

 

RELATEDNESS OF THE GOODS AND SERVICES

 

The goods and services are compared to determine whether they are similar, commercially related, or travel in the same trade channels.  See Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369-71, 101 USPQ2d 1713, 1722-23 (Fed. Cir. 2012); Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1165, 64 USPQ2d 1375, 1381 (Fed. Cir. 2002); TMEP §§1207.01, 1207.01(a)(vi).

 

The compared goods and services need not be identical or even competitive to find a likelihood of confusion.  See On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir. 2000); TMEP §1207.01(a)(i).  They need only be “related in some manner and/or if the circumstances surrounding their marketing are such that they could give rise to the mistaken belief that [the goods and services] emanate from the same source.”  Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007)); TMEP §1207.01(a)(i).

 

Determining likelihood of confusion is based on the description of the goods and/or services stated in the application and registration at issue, not on extrinsic evidence of actual use.  See In re Detroit Athletic Co., 903 F.3d 1297, 1307, 128 USPQ2d 1047, 1052 (Fed. Cir. 2018) (citing In re i.am.symbolic, llc, 866 F.3d 1315, 1325, 123 USPQ2d 1744, 1749 (Fed. Cir. 2017)).  

 

In this case, the application uses the broad Class 41 wording “entertainment”, which is presumed to encompass all services of the type described, including those in registrant’s more narrow wording, “Arranging and conducting of concerts; concert booking; entertainment, namely, live music concerts”; applicant uses the broad Class 41 wording “providing online electronic publications, not downloadable”, which is presumed to encompass all goods and services of the type described, including registrant’s more narrow Class 16 goods “magazines regarding computer networks and searching and retrieving information, sites, and other resources on computer networks”; and application and registrant use the overlapping Class 42 wordings “computer services, namely, creating indexes of information, sites, and other resources available on computer networks” and “computer services, namely, creating indexes of information, sites, and other resources available on computer networks for others”.  See, e.g., In re Solid State Design Inc., 125 USPQ2d 1409, 1412-15 (TTAB 2018); Sw. Mgmt., Inc. v. Ocinomled, Ltd., 115 USPQ2d 1007, 1025 (TTAB 2015).  Thus, applicant’s and registrant’s goods and services are legally identical.  See, e.g., In re i.am.symbolic, llc, 127 USPQ2d 1627, 1629 (TTAB 2018) (citing Tuxedo Monopoly, Inc. v.Gen. Mills Fun Grp., Inc., 648 F.2d 1335, 1336, 209 USPQ 986, 988 (C.C.P.A. 1981); Inter IKEA Sys. B.V. v. Akea, LLC, 110 USPQ2d 1734, 1745 (TTAB 2014); Baseball Am. Inc. v. Powerplay Sports Ltd., 71 USPQ2d 1844, 1847 n.9 (TTAB 2004)).

 

Additionally, the goods and services of the parties have no restrictions as to nature, type, channels of trade, or classes of purchasers and are “presumed to travel in the same channels of trade to the same class of purchasers.”  In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1268, 62 USPQ2d 1001, 1005 (Fed. Cir. 2002)).  Thus, applicant’s and registrant’s goods and services are related.

 

Based on the analysis above, applicant’s and registrant’s goods and services are related.

 

Because applicant’s and registrant’s marks are similar and the goods and services are related, there is a likelihood of confusion and applicant’s applied-for mark must be refused under Section 2(d) of the Lanham Act.

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.  However, if applicant responds to the refusal, applicant must also respond to the requirements set forth below.

 

IDENTIFICATION OF GOODS & SERVICES

 

The Class 9 identification of goods is indefinite and must be clarified because many of applicant’s Class 9 entries fail to specify the nature of the goods within Class 9; for example, the wording “computer software used to search, retrieve, index, and organize data”, along with all other “computer software” entries, fails to specify whether the goods are in the nature of downloadable or recorded computer software goods, while the wording “compact discs, DVDs and other digital recording media” fails to specify the subject matter featured on the goods, as well as the type of “digital recording media”, such as whether the goods are CDs or DVDs.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Additionally, the Class 9 wording “provider and developer services for the mobile application including finance, online to offline and ad services in the future” in the identification of goods is overbroad and could include goods and services in other classes, such as Class 36 financial services and Class 35 advertisement services.

 

The Class 35 identification of services is indefinite and must be clarified because many of applicant’s Class 35 entries fail to specify the nature of the services within Class 35; for example, the wording “online retail services connected with the sale of downloadable digital music” fails to specify whether the services are in the nature of retail store services featuring downloadable digital music, while the wording “providing market information on goods” fails to specify whether the services are in the nature of providing stock market information, business marketing information, or market research information.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The Class 36 identification of services is indefinite and must be clarified because many of applicant’s Class 36 entries fail to specify the nature of the services within Class 36; for example, the wording “insurance” fails to specify whether the services are insurance brokerage, administration, or subrogation services, while the wording “financial affairs” fails to specify whether the services are financial planning, analysis, or advice services.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The Class 38 identification of services is indefinite and must be clarified because many of applicant’s Class 38 entries fail to specify the nature of the services within Class 38; for example, the wording “telecommunications” fails to specify whether the services are in the nature of telecommunication access services or some other service related to telecommunications, while the wording “electronic mail services” fails to specify whether the services are in the nature of transmission of electronic mail or some other activity related to electronic mail.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The Class 41 identification of services is indefinite and must be clarified because many of applicant’s Class 41 entries fail to specify the nature of the services within Class 41; for example, the wording “education” fails to specify the nature of the services, such as whether they are classes or conferences, and if so, featuring which type of subject matter, while the wording “entertainment” fails to specify the nature of the entertainment services, such as whether they are live performances by a musical group or video production services.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Furthermore, the services “providing online video streaming services” and “providing online music streaming services are classified incorrectly.  Applicant must amend the application to classify the services in International Class 38.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).

 

The Class 42 identification of services is indefinite and must be clarified because many of applicant’s Class 42 entries fail to specify the nature of the services within Class 42; for example, the wording “providing temporary use of nondownloadable online computer software” fails to specify whether the function of the software, while the wording “software as a service” fails to specify the function of the software, as well as whether the “software as a service” services featuring software for a particular function.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Furthermore, the services “processing of computer data” are classified incorrectly.  Applicant must amend the application to classify the services in International Class 35.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).

 

The Class 45 identification of services is indefinite and must be clarified because many of applicant’s Class 45 entries fail to specify the nature of the services within Class 45; for example, the wording “social networking services” fails to specify whether the services are in the nature of online social networking services, while the wording “security services for the physical protection of tangible property and individuals” fails to specify whether the services are security guard services.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Furthermore, the services “political lobbying services” and “lobbying services, other than for commercial purposes” are classified incorrectly.  Applicant must amend the application to classify the services in International Class 35.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).

 

Additionally, the identification of goods and services contains parentheses.  Generally, applicants should not use parentheses and brackets in identifications in their applications so as to avoid confusion with the USPTO’s practice of using parentheses and brackets in registrations to indicate goods and services that have been deleted from registrations or in an affidavit of incontestability to indicate goods and services not claimed.  See TMEP §1402.12.  The only exception is that parenthetical information is permitted in identifications in an application if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity or scope of the identification, e.g., “fried tofu pieces (abura-age).”  Id.

 

Therefore, applicant must remove the parentheses from the identification and incorporate any parenthetical or bracketed information into the description of the goods and services.

 

Finally, applicant is advised to delete or modify all duplicate entries in the identification of goods and services; for example, applicant has included duplicate entries for the Class 9 wording “downloadable films and television programs featuring news, commentary, weather, sports, entertainment, fashion, finance, music, inspiration, health, lifestyle, travel, parenting, science, technology, culture, and wellness provided via a video-on-demand service”, along with other duplicate entries in other classes.  See generally TMEP §§1402.01, 1402.01(a).  If applicant does not respond to this issue, be advised that the USPTO will remove duplicate entries from the identification prior to registration.

 

If modifying one of the duplicate entries, applicant may amend it to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Also, generally, any deleted goods and/or services may not later be reinserted.  TMEP §1402.07(e).

 

Applicant may substitute the following wording, if accurate: 

 

Class 9: Scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, checking in the nature of supervision, life-saving and teaching apparatus and instruments, all being in the nature of cameras, life-saving rafts, video projectors, and scales; apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity, all being in the nature of electric conductors; apparatus for recording, transmission or reproduction of sound or images; blank magnetic data carriers, blank recording computer discs; compact discs, DVDs and other digital recording media in the nature of blank pre-recorded laser disks, featuring content in the nature of music videos; mechanisms for coin-operated apparatus; cash registers, calculating machines, data processing equipment, computers; downloadable computer software to enable users to control fire extinguishing apparatus; fire extinguishing apparatus; downloadable computer software to enable users to locate other game players and play games over communications networks; downloadable computer software for transmitting electronic mail; computer software for electronic messaging; downloadable computer software for electronic transmission of data, images, and documents via a global computer network; downloadable computer software for providing online chat rooms and electronic bulletin boards for transmission of messages among users in the field of general interest; downloadable computer software used to search, retrieve, index, and organize data; downloadable computer software used to enhance the performance and functionality of computer networks; downloadable computer software for searching and retrieving information, websites, and other resources on computer networks;
