I have examined Application SN. 88617359 for the mark “FAC ILE”, and it looks pretty good.  However, there are a couple issues I must address before I can approve the application for publication.  I hope to resolve these issues informally via examiner’s amendment to expedite the prosecution of the application.  Accordingly, the issues are discussed below in detail.

 

First, the description of the mark requires amendment, and I suggest the following:  The mark consist of the stylized lettering “FAC” above the stylized lettering “ILE”.  All the foregoing is on a shaded rectangle.

 

Additionally, the identification of goods requires amendment, and I suggest the following:

 

In Class 9, Downloadable mobile applications to allow customers to access bank account information, transact bank business and bank transactions; Downloadable computer application software for mobile phones, tablets, computers and handheld devices that enables users to access, download and share data, text, content, video, audio, and multimedia, all being electronic files relating to bank business, financial services and bank transactions,  and to facilitate electronic communication between individuals and banking institutions in the fields of communication relating to bank business, financial services and bank transactions
