Dear Mr. Skale,
I am the USPTO Trademark Examining Attorney assigned to Application Nos. 88615904, 88615914, and 88615931 (the AccentCare marks). I have reviewed the applications, and there is a minor issue affecting the identification of services in each application. As each application features the identical identification, the issue and solution is identical for each application.
Specifically, the entry “and providing assisted living and geriatric case management services to senior citizens at private residences, independent living facilities and assisted living facilities” is both indefinite and incorrectly classified. These case management services are properly classified in International Class 45, not Class 44. Since each application already has Class 45, we can simply move this entry to Class 45 via Examiner’s Amendment. Further, applicant must specify the purpose of these services. I have included a proposed amendment modeled after definite entries in our ID Manual. Please let me know if this proposed amendment is acceptable.
Class 44: Health care; health care in the nature of providing assisted living care and daily living activities assistance to senior citizens at private residences, independent living facilities and assisted living facilities;
and providing assisted living and geriatric case management services to senior citizens at private residences, independent living facilities and assisted living facilities; behavioral health services; home health care services; hospices; managed health care services; nursing care; nursing services; occupational therapy services; physical therapy; speech therapy services
Class 45: Personal care assistance of activities of daily living, such as bathing, grooming and personal mobility for mentally or physically challenged people; social service, namely, companionship services for the elderly and disabled;
andproviding assisted living and geriatric case management services , namely, coordination of medical, physical, social, psychological, and legal services for senior citizens at private residences, independent living facilities and assisted living facilities
Please let me know at your nearest convenience if this amendment is acceptable for each application. If so, I will enter the amendment via Examiner’s Amendment as soon as possible. If I do not hear back from you by 5 PM Eastern on Friday, December 20, 2019, I will issue a formal Office Action detailing this requirement.
