We spoke by phone earlier today. Below is the proposed wording for amendment of applicant’s identification of goods, in order to clarify the nature of the goods and ensure proper classification. You will see that “Synthetic textile fibers sold as an integral component of clothing, including but not limited to sportswear, active wear, athleisure wear, jeans, shirts, pants and hosiery” has been moved to Class 25, where it is properly classified, subject to clarification of the overbroad wording “including but not limited to” and “sportswear, active wear, athleisure wear”. Further, “spandex fibers used in fabrics and sold as an integral component of clothing, including but not limited to sportswear, active wear, athleisure wear, jeans, shirts, pants and hosiery” has been clarified in Class 22. Note that applicant already has “spandex fibers used in fabrics … sold as an integral component of clothing, including but not limited to sportswear, active wear, athleisure wear, jeans, shirts, pants and hosiery” in Class 25, subject to clarification of indefinite wording.
