Subject: RE: Serial no. 88611903 CRYSTALCLEAR

Ms. Gadson,

Thank you for speaking with me this morning.  Per our discussion, the Applicant agrees to amend the goods as discussed and detailed below.

The current identifications are:

International Class 001   Mixtures of liquid crystals and monomers; mixtures of pre-polymer monomers, nematic liquid crystals; mixtures of photopolymerizable monomers, liquid crystals, and photoinitiators; chemicals having liquid crystal properties for use in the manufacture of waveguides, gratings and lenses

As to class 001, consistent with the suggested identifications, Applicant proposes the following amended description:

Industrial chemical mixtures of liquid crystals and monomers in the optics, display, and electronics industries; industrial chemical mixtures of pre-polymer monomers and nematic liquid crystals in the optics, display, and electronics industries; industrial chemical mixtures of pre-polymer monomers in the optics, display, and electronics industries; industrial chemical mixtures of nematic liquid crystals in the optics, display, and electronics industries; industrial chemical mixtures of photopolymerizable monomers, liquid crystals, and photoinitiators in the optics, display, and electronics industries; chemicals having liquid crystal properties for use in the manufacture of waveguides, gratings and lenses in the optics, display, and electronics industries;

If the above amendments are acceptable, Applicant authorizes entry of the amendments by way of an examiner’s amendment.  If any issues remain unresolved, Applicant remains available to address any concerns, and my direct contact information is provided below.

Best Regards,
Charles

Mr. Halloran,

There are some issues in the above mentioned filing that can be resolved by an examiner’s amendment. The issues are detailed below.

1)     A number of your identifications are indefinite and require removal of ambiguous commas and more specificity regarding the nature of the goods. Additionally, it is highly suggested that applicant specify its industry for all goods listed in International Class 001 so that respective identifications will make clear which trade channels applicant’s goods travel in. Failure of the applicant to specify its industry could result in broad identifications that necessitate a likelihood of confusion refusal.

Your current identifications are:

International Class 001   Mixtures of liquid crystals and monomers; mixtures of pre-polymer monomers, nematic liquid crystals; mixtures of photopolymerizable monomers, liquid crystals, and photoinitiators; chemicals having liquid crystal properties for use in the manufacture of waveguides, gratings and lenses

               The following identifications are suggested to clarify your identifications:

International Class 001   Industrial chemical mixtures of liquid crystals and monomers in the {indicate specific industry for which the goods are intended, e.g., paper, oil drilling, etc.} industry; industrial chemical mixtures of pre-polymer monomers and nematic liquid crystals in the {indicate specific industry for which the goods are intended, e.g., paper, oil drilling, etc.} industry; industrial chemical mixtures of photopolymerizable monomers, liquid crystals, and photoinitiators in the {indicate specific industry for which the goods are intended, e.g., paper, oil drilling, etc.} industry; chemicals having liquid crystal properties for use in the manufacture of waveguides, gratings and lenses in the {indicate specific industry for which the goods are intended, e.g., paper, oil drilling, etc.} industry

Please advise me by Friday, December 13, 2019 at 4:00 PM EST if you would like to resolve the noted issues via an examiner’s amendment. If I do not hear from you by the stated date and time then I will proceed with an office action in this matter.

Kind Regards,
