USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by attorney for applicant, Leo Loughlin on January 17, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

The identification of goods in International Classes 5 and 10 is amended to read as follows: 

 

International Class 5: Pharmaceutical preparations, substances and compositions, namely, medical diagnostic reagents in the nature of antibody-drug conjugates, immuno-oncology compounds in the nature of medicinal preparations for the treatment of infectious diseases and for use in oncology, and compounds for auto-immune diseases, namely, pharmaceutical preparations for the treatment of immune system related diseases and disorders; Biological and biochemical drugs and cultures for medical use, namely, biological preparations for the treatment of cancer, cultures of microorganisms for medical use, and biological tissue cultures for medical purposes; Pharmaceutical active substances, namely, drug delivery agents in the form of capsules that provide controlled release of the active ingredients for a wide variety of pharmaceuticals; Pharmaceutical components and ingredients, namely, drug delivery agents in the form of powders that provide controlled release of the active ingredients for a wide variety of pharmaceuticals

 

International Class 10: Surgical and medical devices, apparatus and instruments, namely, surgical instruments and apparatus, surgical devices and instruments, surgical apparatus and instruments, medical instruments for cutting tissue, and medical instrument for performing biopsies, medical fluid injectors, injection devices for pharmaceuticals, syringes for medical purposes, disposable syringes for medical purposes; Orthopedic articles, namely, orthopedic walkers, orthopedic supports, orthopedic braces and orthopedic cushions; injection apparatus for medical purposes, namely, injection needles and injection instruments with needles
