ARGUMENT(S)
The subject application was suspended December 9, 2019 pending the outcome of prior filed Application Serial No. 88508280 for SOLO and Design, now Registration No. 6269254, owned by Solo S.r.l. Applicant and Solo S.r.l. have entered into a Co-Existence Agreement, pursuant to which Solo S.r.l. and Applicant agreed that there is no likelihood of confusion between Applicant's mark and the Solo S.r.l. registration, and also confirms Solo S.r.l.'s consent to Applicant registering and using Applicant's mark, in any country, in connection with the applied for goods and services. A copy of the Co-Existence Agreement is enclosed with this response. In light of the response above, Applicant respectfully requests that the subject application be removed from suspension and be placed in condition for publication for opposition. The Examining Attorney is requested to telephone the undersigned attorney for Applicant in the event a telephone conference could expedite the processing of this application.
