The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

1.  Advisory – Search Results:

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

2.  Requirement – Identification of Goods / Recitation of Services:

A written application must specify the particular goods and/or services on or in connection with which the applicant uses, or has a bona fide intention to use, the mark in commerce.  15 U.S.C. §§1051(a)(2)  and 1051(b)(2); 37 C.F.R. §2.32(a)(6).  To "specify" means to name in an explicit manner.  The identification should set forth common names, using terminology that is generally understood.  The identification of goods and/or services must be specific, definite, clear, accurate, and concise.   See In re Societe Generale des Eaux Minerales de Vittel S.A., 1 USPQ2d 1296 (TTAB 1986) , rev’d on other grounds, 824 F.2d 957, 3 USPQ2d 1450 (Fed. Cir. 1987); The Procter & Gamble Co. v. Economics Laboratory, Inc., 175 USPQ 505 (TTAB 1972), modified without opinion, 498 F.2d 1406, 181 USPQ 722 (C.C.P.A. 1974); In re Cardinal Laboratories, Inc., 149 USPQ 709 (TTAB 1966) ; California Spray-Chemical Corp. v. Osmose Wood Preserving Co. of America, Inc., 102 USPQ 321 (Comm’r Pats. 1954); Ex parte The A.C. Gilbert Co., 99 USPQ 344 (Comm’r Pats. 1953).  TMEP §1402.01.

 

As to International Class 012:

The wording “padding for motor vehicle seats” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  Please note if applicant is providing “padding materials not of rubber, plastic, paper, or cardboard” these goods are properly classified in International Class 022.

 

The wording “seat pads” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  For example, “vehicle seat cushions” are properly classified in International Class 012, however, “seat cushions” are properly classified in International Class 020.  Please clarify the goods for the record and classify appropriately.

 

Applicant has classified “chair pads” in International Class 012; however, the proper classification is International Class 020.  Therefore, applicant may respond by (1) adding International Class 020 to the application and reclassifying these goods and/or services in the proper international class, (2) deleting “chair pads” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods and/or services in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

As to International Class 035:

The wording “consulting and information concerning industrial operations and management” in the identification of services is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must amend this wording to specify the common commercial or generic name of the services.  See TMEP §1402.01.  Specifically, please note for consulting services and the service of providing information, applicant must clearly identify the subject matter of the consulting and information as these services are classified depending upon the subject matter.  Please clarify the subject matter of the consulting and information being provided and classify appropriately.

 

The wording “automotive manufacturing consulting services” in the identification of services is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Consulting services are classified according to the subject matter of the consulting service; for example, “business management consultancy” is classified in International Class 35 and “computer technology consultancy” is classified in International Class 42.  TMEP §1402.11(e).    In this case, applicant may state, “consulting services in the field of custom automotive manufacturing” in International Class 040, if accurate.

 

The wording “consulting services for automotive parts manufacturers and automotive manufacturers” in the identification of services is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  As stated above, consulting services are classified according to the subject matter of the consulting service; for example, “business management consultancy” is classified in International Class 35 and “computer technology consultancy” is classified in International Class 42.  TMEP §1402.11(e).    In this case, applicant may state, “manufacturing process consulting services for automotive parts manufacturers and automotive manufacturers” in International Class 040, if accurate.

 

The wording “technical consulting in the field of automotive manufacturing” in the identification of services is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must amend this wording to specify the common commercial or generic name of the services.  See TMEP §1402.01.  As stated above, consulting services are classified according to the subject matter of the consulting service; for example, “business management consultancy” is classified in International Class 35 and “computer technology consultancy” is classified in International Class 42.  TMEP §1402.11(e).    In this case, applicant may state, “technical consulting services in the field of custom automotive manufacturing” in International Class 040, if accurate.

 

Applicant has classified “custom development, design and manufacture of foam products for others, namely, product design consulting services, design and testing of automotive parts for others, product development services, industrial design, and design of automotive parts.” in International Class 035; however, the proper classification is International Class 042.  Therefore, applicant may respond by (1) adding International Class 042 to the application and reclassifying these goods and/or services in the proper international class, (2) deleting “custom development, design and manufacture of foam products for others, namely, product design consulting services, design and testing of automotive parts for others, product development services, industrial design, and design of automotive parts.” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods and/or services in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.  Additionally, for the product design consulting services, applicant may state, “new product design consulting services” in Class 042, if accurate.

 

Applicant may substitute the following wording, if accurate: 

 

International Class 012:

Seating for vehicles, namely, automobile seat cushions, motor car seats, vehicle seats, motorcycle seats, golf cart seats; vehicle seat cushions.

 

International Class 020:

Seat cushions; Chair pads.

International Class 022:

Padding for motor vehicle seats, namely, padding materials not of rubber, plastic, paper or cardboard.

 

International Class 035:

Industrial management assistance and consulting for manufacturers of products made from polyurethane foam, namely, business management consultancy, business consulting and business information concerning industrial operations and management, and business management assistance.

 

International Class 040:

Industrial management assistance and consulting for manufacturers of products made from polyurethane foam, namely, consulting services in the field of custom automotive manufacturing;  Industrial management assistance and consulting for manufacturers of products made from polyurethane foam, namely manufacturing process consulting services for automotive parts manufacturers and automotive manufacturers;  Industrial management assistance and consulting for manufacturers of products made from polyurethane foam, namely, technical consulting services in the field of custom automotive manufacturing.

 

International Class 042:

Custom development, design and manufacture of foam products for others, namely, new product design consulting services, design and testing of automotive parts for others, product development services, industrial design, and design of automotive parts.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

Requirements for a Multiple Class Application:

The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 44:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  The application identifies goods and/or services that are classified in at least six classes; however, applicant submitted a fee(s) sufficient for only two class(es).  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

The fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class.  See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a).  See more information regarding the requirements for maintaining the lower TEAS RF fee and, if these requirements are not satisfied, for adding classes at a higher fee using regular TEAS.

 

3.  Requirement – Unsigned Application:

The application was unsigned, resulting in the application not being properly verified.  See TMEP §804.  Applicant must properly sign and therefore verify the application in an affidavit or signed declaration under 37 C.F.R. §2.20.  See 37 C.F.R. §§2.2(n), 2.33(a), (b)(2)-(c), 2.34(a)(2), (a)(3)(i), (a)(4)(ii); TMEP §804.02. 

 

The following statements must be verified:  That applicant has a bona fide intention to use the mark in commerce and had a bona fide intention to use the mark in commerce as of the application filing date; that applicant believes applicant is entitled to use the mark in commerce on or in connection with the goods or services specified in the application; that to the best of the signatory’s knowledge and belief, no other persons, except, if applicable, concurrent users, have the right to use the mark in commerce, either in the identical form or in such near resemblance as to be likely, when used on or in connection with the goods/services of such other persons, to cause confusion or mistake, or to deceive; and that the facts set forth in the application are true.  37 C.F.R. §§2.33(b)(2), (c), 2.34(a)(2), (a)(3)(i), (a)(4)(ii).  For more information about this, see the Verified statement webpage.

 

To provide these verified statements.  After opening the correct TEAS response form, answer “yes” to wizard question #10, and follow the instructions within the form for signing.  In this case, the form will require two signatures:  one in the “Declaration Signature” section and one in the “Response Signature” section. 

 

4.  Advisory – TEAS RF Applicants:

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
