Dear Mr. Horlacher,

 

I am the assigned trademark examiner for the above-referenced applications. I have reviewed the applications and in each case the applicant must amend the class 9 identification of goods.

 

Specifically, the class 9 identifications currently read “Computer software for online utility payment services” for Serial No. 88591112 RESIDENTUTILITY and “Computer software to aid in accounting, marketing, and management tasks for property management companies” for 88591108 SITETABLET. In applications filed after January 1, 2019, class 9 software identifications must specify that the software is either downloadable or recorded on computer media, to avoid confusion with software-as-a-service, which is classified in class 42.

 

With your approval, therefore, I will issue an examiner’s amendment for each application, amending the class 9 identification in each to begin with “downloadable computer software.”

 

If you agree that the changes are acceptable, we can move more quickly through the registration process for this application. Please contact me by email or phone by 1 PM EST on Thursday, January 9, 2020, if you agree to allow me to correct the above by examiner’s amendment. Also, do not hesitate to contact me should you have any questions. If I do not hear from you by that time, I will issue a formal Office action on this issue.
