I have examined Applications SNs. 88582603 88582607 88582617, and there are a handful of issues I must address before these applications can be approved.  I hope to expedite the prosecution via examiner’s amendments.  For this purpose, the issues for each application are discussed below.

 

SN. 88582603

·         The description of the mark requires amendment, and I suggest the following:  The mark consists of three stylized Korean characters.  If you approve of this amendment, I can take care of it on my end.

·         A consent statement must be made of record.  Because the applicant signed the declaration attached to the application, consent can be presumed.  Thus, I suggest adding the following statement to the record:  The name shown in the mark identifies a living individual whose consent to register is made of record.  If you approve of this statement, I can add it to the record on my end.

·         The goods identified as “shrimp sauce, namely, jumbo shrimp sauce” belong in Class 30.  Thus, either these goods must be deleted by, or Class 30 must be added to the application.  I can delete the goods from the application via examiner’s amendment and subsequently approve the application.  Alternatively, I can reclassify the aforementioned goods in Class 30 via examiner’s amendment and require an additional fee for the added class via priority action.  Please let me know how you would like to proceed.

·         The description of the mark requires amendment, and I suggest the following:  The mark consists of three stylized Korean characters.  If you approve of this amendment, I can take care of it on my end.

·         The identification of services requires amendment because the wording “restaurant services featuring Korean restaurants specialized in crabs” is unclear and may exceed the scope of the services identified in the foreign registration.  Additionally, the wording “restaurant services, namely, restaurant services rendered in the framework of franchising” encompasses services in other classes, e.g., for example:  “restaurant franchising, namely, offering business management assistance in the establishment and/or operation of restaurants” in Class 35, or “franchising services, namely, providing financial information and advice regarding the establishment and/or operation of restaurants” in Class 36.  Accordingly, I suggest the following amendment:  In Class 43, Korean restaurant services featuring crab; Restaurants, namely, buffet restaurants; Self-service restaurant services; Restaurant services; Food preparation services; Food and drink catering; Bar services, namely, Korean bars; Restaurants, namely, Korean restaurants.  If you approve of this amendment, I can take care of it on my end.

·         The description of the mark requires amendment, and I suggest the following:  The mark consists of a three stylized Korean characters in yellow under a stylized crab in gold and black on a stylized circular shape in black that has a decorative, wavy border in gold, and a paralleling interior border line in gold.  If you approve of this amendment, I can take care of it on my end.

·         A consent statement must be made of record.  Because the applicant signed the declaration attached to the application, consent can be presumed.  Thus, I suggest adding the following statement to the record:  The name shown in the mark identifies a living individual whose consent to register is made of record.  If you approve of this statement, I can add it to the record on my end.
