SEARCH RESULTS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
DISCLAIMER REQUIRED
In this case, applicant must disclaim the wording “KIDS” because it is not inherently distinctive. This unregistrable term is at best merely descriptive of a quality, characteristic, function, feature, purpose, or use of applicant’s services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
The attached evidence from the American Heritage Dictionary shows that “KID” means “child.” Here, the applicant’s identification of services specifically identifies entertainment services for “children.” Accordingly, “KIDS” merely describes applicant’s services because the services are for children, or “KIDS”.
Applicant may respond to this issue by submitting a disclaimer in the following format:
No claim is made to the exclusive right to use “KIDS” apart from the mark as shown.

PRIOR REGISTRATION
Applicant must claim ownership of any similar registered mark that it owns. See TMEP §812.01. In this case, applicant must assert ownership of U.S. Registration No. 4367537, if appropriate. Alternatively, applicant must state for the record that it is not the owner of this registration.
NAME IN THE MARK
To register a mark that consists of or comprises the name of a particular living individual, including a first name, pseudonym, stage name, or nickname, an applicant must provide a written consent personally signed by the named individual. 15 U.S.C. §1052(c); TMEP §§813, 1206.04(a).
Accordingly, if the name in the mark does not identify a particular living individual, applicant must submit a statement to that effect (e.g., “The name shown in the mark does not identify a particular living individual.”).
However, if the name in the mark does identify a particular living individual, applicant must submit both of the following:
(1) The following statement: “The name(s) shown in the mark identifies a living individual(s) whose consent(s) to register is made of record.”
If the name is a pseudonym, stage name, or nickname, applicant must provide the following statement:
“RABITO” identifies Juan Carlos Fernandez, a living individual whose consent is of record.
(2) A written consent, personally signed by the named individual(s), as follows:
I, Juan Carlos Fernandez, consent to the use and registration of my pseudonym, “RABITO”, as a trademark and/or service mark with the USPTO.

The following English translation is suggested:
The English translation of “RABITO” in the mark is “little tail”.

ADDITIONAL FEE REQUIRED: TEAS PLUS STATUS LOST
The additional fee is required even if applicant later corrects these application requirements.
