Good morning, Mr. Gilbert,
Many of your questions can be answered in the Trademark Basics and Trademark FAQs sections of our website, which you can access here:
Trademark Basics: http://www.gov.uspto.report/trademarks-getting-started/trademark-basics
Trademark FAQs: http://www.gov.uspto.report/learning-and-resources/trademark-faqs
U.S. Patent and Trademark Office employees are not permitted to provide legal advice, and your questions would require legal advice. The information in the links above should answer your questions. If you need to locate an attorney, your local bar association would be a good place to start. Also, some law schools have intellectual property clinics that assist the public if they meet certain criteria.
Regarding the amendments to the mark descriptions in the above-referenced applications, the changes have been entered and the applications will be approved for publication soon.
Kind regards,
Shaila E. Lewis

Oh, I forgot to ask about commercializing the logos, as I have had some luck selling some hats with them.
Sorry I forgot to ask about that in my last email.
What is the process for this to happen and what is the difference between a regular trademark and a commercialized one?
Thank you for your help.
Jeff

Dear Mr. Gilbert,
I can accept the drawings as they are, so you don’t need to amend the drawings. The mark descriptions outlined below in your email are acceptable. I can enter the changes to the mark descriptions for you, if you’d like, and then I will approve the applications for publication. Let me know if you’d like to do this.
Kind regards,
Shaila E. Lewis

Subject: Letter of action
Good Morning.
My name is Jeff Gilbert, and I received two letters from the USPTO regarding two different marks that I am trying to have Trademarked.
They are serial #'s 88574050 and 88577719
From what I read in the letter, I think I just need to resubmit the marks in black and white, because the letter said I could have no grey or color in the drawings that I originally sent. I guess since I am not claiming a color that it needs to just be black and white.
Also I think the letter asked me to give a better description of the marks.
I am attaching two files of the marks to see if you think they will be acceptable.
This will be my description of serial # 88574050
The mark consists of a circle of varied thickness with a rabbit in the center with one upright ear and a flopped ear wearing sunglasses with a glare on each lens.
The description of serial # 88577719
The mark consists of a rabbit with one upright ear and a flopped ear wearing sunglasses with a glare on each lens.
Hopefully these clarifications will lead to a successful trademark.
If you could also guide me in how I submit these changes to finish the process I would appreciate it.
Thank you for your time.
Jeff Gilbert
