Good morning,

 

I am the examining attorney for the above referenced trademark application.  I have reviewed the application and there are a few issues that require resolution for the application to proceed.  I am hoping we can handle this over the phone/email via an Examiner’s Amendment where, upon your authorization, I can make the changes on my end.  This method will help expedite the process.

 

 

1)     Identification of Goods:  Applicant will need to amend the Identification of goods in order to clarify the nature of the “thermal compresses,” which appears to fall into Class 10.  Applicant may adopt the following identification, if accurate:

 

Class 5:  Eye compresses; thermal compresses 

 

Class 10:  Thermal compresses in the nature of chemically activated hot compresses

 

                             

PLEASE NOTE:  If the applicant decides to add additional classes, then this issue can be resolved via an Examiner’s Amendment/Priority Action, whereupon, I can make the changes to the Identification of goods via the Examiner’s Amendment portion, but the applicant will have to submit a formal response in order to submit a fee, dates of use, and verified specimen for the additional class(es).

 

 

Upon your authorization to the above requirements, I will be happy to issue an Examiner’s Amendment (or Examiner’s Amendment/Priority Action to add multiple classes) to expedite processing of the application.  You may email me or call me with the authorization.  If you have any questions or concerns, please feel free to contact me at my information below.

 

If I am unable to hear from you by Wednesday, November 13th, I will issue an Office Action with the above requirements and you will have six months to respond in writing.
