EXAMINER’S AMENDMENT

Issue date:  November 04, 2019

USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

No reply is necessary.

Translation of Foreign Wording

Pursuant to applicant’s submission that “if a translation is required ATIPICA with an accent "ATÍPICA" translated from the Spanish language means atypical” and the evidence attached, the following translation statement is added to the record:

The English translation of the word “ATIPICA” in the mark is “ATYPICAL”.

Please note that the proposed mark ATIPICA is translated into ATYPICAL in English even without the accent.  Please also see attached registration in which the word ATIPICO, without an accent, has been translated into ATYPICAL also.

See 37 C.F.R. §§2.32(a)(9), 2.61(b); TMEP §§809, 809.03.

This application is now in condition for publication.
