Subject: RE: 88566584 BIO RAZOR follow up regarding disclaimer of BIO
Dear Laura,
Regarding the mark, BIO RAZOR, in addition to the amendment of the identification of goods as we discussed, we also require a disclaimer of the descriptive term, BIO, apart from the mark as shown. Please note that a disclaimer of an unregistrable part of a mark will not affect the mark’s appearance. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 979-80, 144 USPQ 433, 433 (C.C.P.A. 1965).
If this is acceptable to you, please confirm by e-mail response or call and I will make the amendment in the Examiner’s Amendment office action.
Thank you,
Asmat
