I am the examining attorney assigned to the application cited above. The following must be resolved before the application can proceed to registration.
Identification of Goods
Some of the wording in the identification of goods is indefinite and must be clarified because it could encompass goods in other classes or is not specific enough as to the type of product. See TMEP §§1402.01, 1402.03. For example, “Air circulation apparatus” encompasses “Accessories for fireplaces consisting primarily of metal ducts and metal adaptors used to increase the amount of heat recovered from the fireplace using a blower or natural convection” as well as “ceiling fans” or “air conditioners.” It is unclear what “apparatus” and “installations” encompass. Applicant must clarify these identifications without duplicating existing wording.
Using applicant’s website http://www.cwcnt.co.kr/default/index_en.php as a guide, applicant may substitute the following wording, if accurate:
“Air circulation apparatus, namely, air conditioners; Air circulators, namely, air exchangers for cleaning and purifying air; Range hoods; Extractor hoods for kitchens; Ventilation fans for industrial purposes; Ventilation hoods for laboratories; Ventilation hoods; Ventilation louvers; Ventilating fans; Installations for ventilation, namely, ventilating exhaust fans; Ventilation air-conditioning installations and apparatus, namely, ventilating fans for commercial and industrial use; Ventilators for laboratories” in International Class 011
For assistance with identifying and classifying goods in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tmidm.gov.uspto.report/id-master-list-public.html. See TMEP §1402.04.
CONCLUSION: If an authorized person (e.g., attorney of record– please provide title) agrees to the above, I can prepare an Examiner's Amendment and approve the application immediately. Alternatively, if you propose new amendments clarifying the nature of the goods and the wording is not directly from the USPTO's online ID Manual, please explain why you believe the wording would be acceptable and properly classified.
If I do not hear from anyone by the close of business on TUESDAY, 5pm (EST), I will have to proceed with a formal Office Action. If you need additional time, please let me know and I can issue a Priority Action; you may then email me to resolve the issues.
