REQUEST FOR SPECIAL HANDLING DENIED

The request for special handling of the above-identified trademark application was received on
July 29, 2019.
A request for special handling is granted only for new applications that are identical to a previously owned registration that was cancelled or expired for inadvertently failing to file an acceptable Section 8 Affidavit or Section 9 Renewal Application. TMEP §§702.02 and 1710.
The request for special handling is based on application serial no. 88527139 being identical to previously filed prior application serial no. 87128795. However, application serial no. 87128795 was abandoned after no Statement of Use was filed and never matured to registration. Inasmuch as the request does not state a valid basis to make the application special under TMEP 702.02 or TMEP 1710, the request is denied.
Decision: Request for special handling is hereby DENIED.
The application will be processed in the order it was received.
