SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
THE DESCRIPTION OF THE MARK MUST BE AMENDED
Generic color names must be used to describe the colors in the mark, e.g., red, yellow, blue. TMEP §807.07(a)(i)-(ii). If black, white, and/or gray represent background, outlining, shading, and/or transparent areas and are not part of the mark, applicant must so specify in the description. See TMEP §807.07(d).
The following description is suggested, if accurate, with suggested additions in bold:
The mark consists of the stylized wording "SPICA" in italic capital letters. The letter "A" in the word "SPICA" was designed to look like a triangle shape with an opening towards the bottom right hand side. The wording "SPICA" has a continuous color tone of dark blue on the left side changing to blue in the middle and changing to light blue on the right side. There are four oblong shapes of different lengths and one circle arranged in a semicircle shape on top of the letters "P" and "I". The lengths of the oblong shapes are arranged from longest to the shortest arranging in order from left to right, with the oblong shapes and circle also having a continuous color tone of dark blue on the left side changing to blue in the middle and changing to light blue on the right side, with the light blue circle farthest to the right. White is background and is not a claimed feature of the mark.
