My name is Michael Larkey and I am an examining attorney with the U.S. Patent and Trademark Office. I work for the federal government and I have been assigned to review the trademark applications Serial No. 88525914 SPICA and 88525898 SPICA. There is a few small issues I’d like to discuss with you about the application that can be resolved with your agreement.
Serial No. 88525914 SPICA
- Mark Description/Color Claim: The mark description provided does not accurately describe all parts of the mark. In addition, the description claimed either a white or transparent background, but only one can be claimed. With your permission, I can amend the mark description and claim to make the following changes:
Mark Description: The mark consists of the stylized wording "SPICA" in italic capital letters. The letter "A" in the word "SPICA" was designed to look like a triangle shape with an opening towards the bottom right hand side. The wording "SPICA" has a continuous color tone of dark blue on the left side changing to blue in the middle and chaining to light blue on the right side. There are four oblong shapes of different lengths and one circle arranged in a semicircle shape on top of the letters "P" and "I". The lengths of the oblong shapes are arranged from longest to the shortest arranging in order from left to right, with the circle farthest to the right. White is background and is not a claimed feature of the mark.
Colors Claimed: The colors blue, dark blue, and light blue are claimed as a feature of the mark.

- Mark Description/Color Claim: The mark description provided does not accurately describe all parts of the mark. In addition, the description claimed either a white or transparent background, but only one can be claimed. With your permission, I can amend the mark description and claim to make the following changes:
Mark Description: The mark consists of the stylized green wording "SPICA" in capital letters. The letter "A" in the word "SPICA" is designed to look like an up-side down letter "V" with a solid triangle inside. A curved line starting on top of the letter "C" going back and around and over the letter "P" ends with a leaf shape under the letter "A". The curve-like line is green on each end and fades into a light green in the middle. Beneath the “I” and “C” of “SPICA” and interrupting the curved line, there are three four-pointed stars in light green. White is background and is not a claimed feature of the mark.
Colors Claimed: The colors green and light green are claimed as a feature of the mark.
Please respond as whether to whether you agree with these amendments. If you agree, I can make the amendment through what is called an examiner’s amendment. You do not need to take any further action in regards to this amendment and you will receive a copy of the amendment once it is entered. After that, the case will be published for opposition.
