USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. As agreed to by Yan Liu, Vice-President of applicant, on October 12, 2019, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
THE DESCRIPTION OF THE MARK HAS BEEN AMENDED
The following statements describing color in the mark replace the current description of color in the mark of record:
The colors green and light green are claimed as a feature of the mark.
The mark consists of the stylized green wording "SPICA" in capital letters. The letter "A" in the word "SPICA" is designed to look like an up-side down letter "V" with a solid triangle inside. A curved line starting on top of the letter "C" going back and around and over the letter "P" ends with a leaf shape under the letter "A". The curve-like line is green on each end and fades into a light green in the middle. Beneath the “I” and “C” of “SPICA” and interrupting the curved line, there are three four-pointed stars in light green. White is background and is not a claimed feature of the mark.
