SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE

 

Registration is refused because the applied-for mark merely describes a feature, characteristic, purpose, function, subject matter, or use of applicant’s services.  Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.

 

A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose, or use of an applicant’s goods and/or services.  TMEP §1209.01(b); see, e.g., In re TriVita, Inc., 783 F.3d 872, 874, 114 USPQ2d 1574, 1575 (Fed. Cir. 2015) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005) (citing Estate of P.D. Beckwith, Inc. v. Comm’r of Patents, 252 U.S. 538, 543 (1920)). 

 

The determination of whether a mark is merely descriptive is made in relation to an applicant’s goods and/or services, not in the abstract.  DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012); In re The Chamber of Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012); TMEP §1209.01(b); see, e.g., In re Polo Int’l Inc., 51 USPQ2d 1061, 1062-63 (TTAB 1999) (finding DOC in DOC-CONTROL would refer to the “documents” managed by applicant’s software rather than the term “doctor” shown in a dictionary definition); In re Digital Research Inc., 4 USPQ2d 1242, 1243-44 (TTAB 1987) (finding CONCURRENT PC-DOS and CONCURRENT DOS merely descriptive of “computer programs recorded on disk” where the relevant trade used the denomination “concurrent” as a descriptor of a particular type of operating system). 

 

“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.”  In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).

 

In this case, the applied-for mark is CERTIFI, in standard characters, for the following:

 

-          Class 35: Billing; bill presentment services; automated bill presentment services; accounting services

-          Class 36: Financial services, namely, managing bill presentation and bill payment services for others, automated bill presentation and bill payment services; payment processing services in the field of healthcare; bill consolidation services

-          Class 42: Software as a service (SaaS) for billing, bill payment and accounting

 

A novel spelling or an intentional misspelling that is the phonetic equivalent of a merely descriptive word or term is also merely descriptive if purchasers would perceive the different spelling as the equivalent of the descriptive word or term.  See In re Quik-Print Copy Shop, Inc., 616 F.2d 523, 526 & n.9, 205 USPQ 505, 507 & n.9 (C.C.P.A. 1980) (holding “QUIK-PRINT,” phonetic spelling of “quick-print,” merely descriptive of printing and photocopying services); In re Calphalon Corp., 122 USPQ2d 1153, 1163 (TTAB 2017) (holding “SHARPIN”, phonetic spelling of “sharpen,” merely descriptive of cutlery knife blocks with built-in sharpeners); In re Carlson, 91 USPQ2d 1198, 1203 (TTAB 2009) (holding “URBANHOUZING,” phonetic spelling of “urban” and “housing,” merely descriptive of real estate services); TMEP §1209.03(j).

 

 

 

CERTIFY means “To confirm formally as true, accurate, or genuine” or “To guarantee as meeting a standard”. See attached, or http://www.ahdictionary.com/word/search.html?q=certify.

 

 

Further, applicant’s specimen of record states that applicant’s services are “IT70 Certified for State and Federal contracts”. Applicant’s services and function of the SAAS software is to validate “enrollment accuracy and volume up front we reduce labor costs, payment delays and client frustration that occurs when employer systems are not in sync with your billing records.” See attached, or http://www.certifi.com/services/.

 

As illustrated by the attached evidence, the wording, CERTIFI, describes a characteristic, feature, function, or subject matter of applicant’s services, namely, providing confirmed accurate and genuine (CERTIFI or CERTIFY) results as to billing and bill payments.

 

Accordingly, the proposed mark is merely descriptive, and registration is refused on the Principal Register under Section 2(e)(1).  Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration.  However, if applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.

 

RESPONSE OPTION

 

The applied-for mark has been refused registration on the Principal Register.  Applicant may respond to the refusal by submitting evidence and arguments in support of registration and/or by amending the application to seek registration on the Supplemental Register.  See 15 U.S.C. §1091; 37 C.F.R. §§2.47, 2.75(a); TMEP §§801.02(b), 816.  Amending to the Supplemental Register does not preclude applicant from submitting evidence and arguments against the refusal(s).  TMEP §816.04.

 

EXPLANATION OF MARK’S SIGNIFICANCE REQUIRED

 

 

To permit proper examination of the application, applicant must explain whether the wording in the mark “CERTIFI” or “CERTIFY” has any significance in the trade or industry or as applied to applicant’s goods and/or services, or if such wording is a “term of art” within applicant’s industry.  See 37 C.F.R. §2.61(b); TMEP §814. 

 

In addition, applicant must respond to the following:

 

·         Whether CERTIFI or CERTIFY is used to describe a characteristic, feature, or purpose of applicant’s services

 

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.

 

 

 

 

SPECIMEN REFUSAL – USE IN COMMERCE

 

-          This Refusal only pertains to Classes 35 and 36

 

Registration is refused because the specimen does not show the applied-for mark in use in commerce in International Classes 35 and 36.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). 

 

Specifically, the specimen of record comprises of applicant’s website advertising applicant’s “platform”, depicting the applied-for mark, CERTIFI. However, the specimen is not acceptable because there is no specific reference or mention of the services identified as: “Billing; bill presentment services; automated bill presentment services; accounting services” and “Financial services, namely, managing bill presentation and bill payment services for others, automated bill presentation and bill payment services; payment processing services in the field of healthcare; bill consolidation services”. That is, the specimen does not create an association between the mark and the identified services – as there is no reference to any Class 35 and Class 36 services as it merely advertises applicant’s “platform” services in Class 42.

 

Applicant’s website appears to include a consulting section, but appears to be IT support services to help consumers regarding the applicant’s platform – also generally classified in Class 42. Thus, the specimen of record is not acceptable to show use of the mark in commerce in connection with the identified services.

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §1301.04(a), (h)(iv)(C).  Specimens comprising advertising and promotional materials must show a direct association between the mark and the services.  TMEP §1301.04(f)(ii).

 

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

 

(1)        Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the services identified in the application or amendment to allege use.  A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20:  “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.”  The substitute specimen cannot be accepted without this statement.

 

(2)        Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

IDENTIFICATION AND CLASSIFICATION OF SERVICES

 

The applicant’s identification of services are as follows:

 

·         Class 35: Billing; bill presentment services; automated bill presentment services; accounting services

·         Class 36: Financial services, namely, managing bill presentation and bill payment services for others, automated bill presentation and bill payment services; payment processing services in the field of healthcare; bill consolidation services

·         Class 42: Software as a service (SaaS) for billing, bill payment and accounting

 

 

The identification and classification of services must be clarified because it fails to describe the underlying nature of the services with particular specificity and/or references services that may be classified in other classes. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s).

 

Specifically, “managing bill presentation” is indefinite and requires further clarification as to the underlying nature of services for classification purposes.

 

“Automated bill presentation . . . . services” are classified in Class 35.

 

“Payment processing services in the field of healthcare” is indefinite and requires further clarification as to the specific field.

 

“Software as a service (SaaS) for billing, bill payment and accounting” is indefinite and requires further clarification as to the underlying nature of services in this class.

 

Accordingly, applicant may adopt any or all of the following identification(s), if accurate:

 

·         CLASS 35: [Acceptable]

 

 

·         CLASS 36: Financial services, namely, managing bill presentation and bill payment services for others, automated bill presentation and [Classified in Class 35] bill payment services; payment processing services in the field of healthcare payments; bill consolidation services

 

 

·         CLASS 42: Software as a service (SaaS) services featuring software for billing, bill payment and accounting

 

 

Applicant’s services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different services or add services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the services will further limit scope, and once services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
