Good Morning Mr. Greenstein,

I am writing concerning the identification of goods in the application 88520092 GOPHER.  Several items are indefinite in that the nature of the goods is not certain, as well as overbroad, in that they might properly be classified in one or more classes.  Having reviewed the identification, I am proposing an identification of goods identical to that in the applicant’s recently allowed application 88315991 GOPHERCAP (Notice of Allowance issued 8/27/2019).  This application was filed on February 26, 2019 having an identical identification to that in the instant application, and similarly, a requirement for an amended identification.  The identification from this application that I am proposing for this application is as follows:

“Smart packaging for animal medication containers comprised of encoded electronic chips for use by veterinarians and pet owners for monitoring dosing, administration and storage conditions of pet medications; hybrid wireless and plug-in devices for transmitting data to temperature recorders and humidity sensors for use in measuring environmental humidity within packaging; electronic labels and tags for sensing and recording multiple inputs relating to environmental conditions and for the detection of use, intrusion, breakage, and integrity of packages, bottles, vials, trays, and pouches; smart packaging for use by veterinarians and pet owners, namely, product packaging inserts in the nature of electronic data recorders and encoded electronic chips with built-in sensors, included with articles in transit or in storage for sensing, monitoring, measuring and recording handling and environment information such as vibration, temperature, humidity, use, intrusion, breakage and integrity of bottles, vials and pouches; Electronic devices comprising electronic data recorders and encoded electronic chips which can be inserted or incorporated into packaging containing pills or medication, which enables veterinarians and pet owners to monitor and record pet medication usage; interactive electronic data recording and transmitting devices which can be integrated into product packaging incorporating circuitry to record usage of package contents, warn of incorrect usage, and optionally transmit usage data to a receiver for use by veterinarians and pet owners; electronic tags for pet medication containers for use by veterinarians and pet owners for sensing and recording multiple inputs relating to handling of said containers and their storage environment; downloadable computer software for programming circuitry contained in pharmaceutical container caps and for processing received information” in International Class 009

“Smart packaging for use by veterinarians and pet owners, namely, product packaging in the nature plastic safety caps for veterinary medicine containers with built-in sensors, included with articles in transit or in storage for sensing, monitoring, measuring and recording handling and environment information such as vibration, temperature, humidity, use, intrusion, breakage and integrity of bottles, vials and pouches; plastic pharmaceutical container safety caps containing integrated circuitry for recording use and transmitting usage data to a monitoring system for use by veterinarians and pet owners” in International Class 021

Please advise if this ID is acceptable.  Thank you for your time concerning this matter.
