To the Commissioner for Trademarks:

Application serial no. 88519080 ARC CLOTHING CO.(Standard Characters, see http://uspto.report/TM/88519080/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Prior Filed Application: 88077210 is DEAD and 79262616 is ARC-FOAM pending application which is a more like a one word altogether label with a distinctive font (logo). Similar cases were allowed to be registered ie Lucky Brand Jeans, Lucky Paradise Clothing, Lucky Streak Clothing - all having LUCKY as the first word. Likelihood of confusion: 5353021 and 1613920 are both registered with an identical mark as ARC, given the fact that both were allowed to be registered under the same category 25. Our label ARC Clothing Co. is unique and is the name of the brand as a whole unlike those registered labels that are exactly the same. We are not claiming rights on ARC by itself or CLOTHING Co. which I see long list of registered trademarks using CLOTHING Co as part of the label. Please reconsider our application and approve for publication for opposition.
