SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

The examining attorney respectfully advises applicant that this Office Action contains the following requirement(s) summarized immediately below and further explained within the body of this Office Action.

 

SUMMARY OF ISSUES that applicant must address:

 

  • IDENTIFICATION OF GOODS and SERVICES -- the requirement to revise the identification of goods and services
  • EXPLANATION OF MARK’S SIGNIFICANCE -- the requirement to provide an explanation of whether the term BEENZ has any significance as used in the mark

 

 

 

Applicant must respond to the requirement(s) set forth below.

 

 

 

IDENTIFICATION OF GOODS and SERVICES

 

The identification of services is indefinite and must be clarified because it lacks specificity.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s).

 

 

The USPTO has the discretion to determine the degree of particularity needed to clearly identify goods and/or services covered by a mark.  In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d 1593, 1597 (TTAB 2014) (citing In re Omega SA, 494 F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007)).  Accordingly, the USPTO requires the description of goods and/or services in a U.S. application to be specific, definite, clear, accurate, and concise.  TMEP §1402.01; see In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d at 1597-98; Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954). 

 

 

 

Applicant may adopt the following wording, if accurate: 

 

 

 

Class 30:         (NO CHANGES) honey; non-medicated lozenges 

 

 

 

Class 35:         Online wholesale and retail store services featuring honey and products that include honey as a primary ingredient; wholesale store services, retail store services, and distribution, namely, {applicant must specify the services contemplated, for example, wholesale food distributorship services, or for example, retail services through direct solicitation by distributors directed to end-users featuring {indicate specific field or goods}} of honey and products that include honey as a primary ingredient 

 

 

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

EXPLANATION OF MARK’S SIGNIFICANCE REQUIRED

To permit proper examination of the application, applicant must provide all the following information:

 

(1)  Explain whether the wording in the mark “BEENZ” has any meaning or significance in the trade or industry in which applicant’s goods and/or services are manufactured or provided, any meaning or significance as applied to applicant’s goods and/or services, or if such wording is a term of art within applicant’s industry. 

 

(2)  Explain whether the wording in the mark “BEENZ” identifies a geographic place. 

 

(3)  Respond to the following questions: 

 

·         Does anyone connected with applicant use the term as a surname?

 

·         Do any of the applicant’s goods look like beans or intended to look like beans?

Applicant must also explain whether “BEENZ” has any meaning in a foreign language.  See 37 C.F.R. §2.61(b); TMEP §814.

If the wording has no English meaning in a foreign language, then the applicant should submit the following statement: The wording “BEENZ” has no meaning in foreign language.

If the wording has meaning in a foreign language,

Applicant must submit an English translation of the mark.  37 C.F.R. §§2.32(a)(9), 2.61(b); TMEP §809. 

 

The following translation statement is suggested: 

 

The English translation of the word “BEENZ” in the mark is “__ ”.

Failure to respond to this request for information can be grounds for refusing registration.  See In re DTI P’ship LLP, 67 USPQ2d 1699, 1701 (TTAB 2003); TMEP §814.

 

 

 

 

ENTITY CLARIFICATION REQUIRED

 

The application identifies applicant as “LTD” and a “LIMITED LIABILITY COMPANY.”  This is not an acceptable legal entity designation because a LIMITED LIABILITY COMPANY normally is abbreviated as “LLC”.  Otherwise, if the applicant is a “LIMITED COMPANY” or a “CORPORATION”, it must so state and amend its entity type accordingly.  See TMEP §803.03.  Therefore, applicant must specify the particular type of legal entity applying, e.g., corporation, association, partnership, or joint venture, and provide the additional information explained below about that entity.  See 37 C.F.R. §§2.32(a)(3)(ii)-(iv), 2.61(b); TMEP §803.03.

 

If applicant is a corporation, applicant must specify the U.S. state or foreign country under which it is incorporated.  TMEP §803.03(c).

 

If applicant is an association, applicant must specify the U.S. state or foreign country under whose laws the applicant is organized or exists, and indicate whether the association is incorporated or unincorporated.  Id.

 

If applicant is a partnership, applicant must specify the U.S. state or foreign country under whose laws the partnership is organized.  TMEP §803.03(b).  In addition, for a U.S. partnership, applicant must list, if not yet specified, the names, legal entities, and national citizenship (for individuals), or the U.S. state or foreign country of organization or incorporation (for businesses) of all general partners.  Id.  For foreign partnerships, the names and citizenships of the general partners are not required.  See id.

 

If applicant is a joint venture, applicant must specify the U.S. state or foreign country under whose laws the joint venture is organized.  Id.  In addition, for a U.S. joint venture, applicant must list the names, legal entities, and national citizenship (for individuals) or the U.S. state or foreign country of organization or incorporation (for businesses) of all active members of the joint venture.  Id.  For foreign joint ventures, the names and citizenships of the active members are not required.  See id.

 

If, in response to the above request, applicant provides information indicating that it is not the owner of the mark, registration will be refused because the application was void as filed.  See 37 C.F.R. §2.71(d); TMEP §§803.06, 1201.02(b).  An application must be filed by the party who owns or is entitled to use the mark as of the application filing date.  See 37 C.F.R. §2.71(d); TMEP §1201.02(b).

 

 

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
