ARGUMENT(S)

Applicant responds to Trademark Examining Attorney Inga Ervin's Office Action sent September 27, 2019.

Please amend the identification of goods to read "Optical instruments and apparatus, namely, binoculars, telescopes, riflescopes, spotting scopes, monoculars, laser rangefinders, night vision scopes; parts of the foregoing articles."

1748278

"Night Vision Scopes" is also a commonly used commercial name, with numerous Google listings. Applicant's Registration No. 4722260 includes the product "night vision scopes."

                                                                       2.

Applicant submits herewith a copy of the German Registration No. 30 2019 014 524 , dated November 12, 2019, expiring on June 19, 2029 (with English translation) upon which the present application is, in part, based. Contingent upon the approval of this application for publication in the Official Gazette, Applicant withdraws its Section 1(b) filing basis. Under the laws of the country of origin, the foreign application or registration includes a standard character claim or the equivalent.
