Mr. Kim,
I’m writing concerning the referenced application. The applicant must disclaim the descriptive term LIGHTENING because it describes the purpose of the goods, namely, a cream to lighten the skin.
Also, the applicant submitted one specimen for both medicated and non-medicated facial creams. The goods shown in the specimen cannot be both. Thus, a specimen is required for Class 3 – facial cream (non-medicated creams).
If you agree to the disclaimer, I will issue an Examiner’s Amendment/Priority action, and you will only need to respond to the requirement for a new specimen.
Please respond before COB Tuesday, September 24, 2019. If I don’t receive a response, I will issue an office action and you may respond to both issues as indicated.
