LIKELIHOOD OF CONFUSION REFUSAL
Registration of the applied-for mark has refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 5262297 and 5601841. Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. The refusal is continued and maintained.
MARK DESCRIPTION
The requirement that applicant must provide an amended description of the mark that includes all the literal and design elements and colors shown in the mark is continued and maintained.
The following description is suggested, if accurate:
“The mark consists of the red letters “GAIA” each within a highly stylized green globe featuring outlines of the continents. The color white represents background and does not form part of the mark.”
CLOSING
The USPTO will periodically check this application to determine if it should remain suspended. See TMEP §716.04. As needed, the trademark examining attorney will issue a letter to applicant to inquire about the status of the reason for the suspension. TMEP §716.05.
