USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Applicant must address issues shown below. On March 10, 2020, the examining attorney and Attorney Karen Johnson discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §708.05.
LIVING INDIVIDUAL STATEMENT
To register a mark that consists of or comprises the name of a particular living individual, including a first name, pseudonym, stage name, or nickname, an applicant must provide a written consent personally signed by the named individual. 15 U.S.C. §1052(c); TMEP §§813, 1206.04(a).
Applicant indicated that the mark does identify a living individual and provided both a statement and written consent. However, the format of both the statement and the consent is incorrect.
Applicant must submit both of the following:
(1) The following statement:
“The name REBECCAFAITH shown in the mark identifies Rebecca Faith Lange, a living individual whose consent is of record.”
(2) A written consent, personally signed by the named individual(s), as follows:
“I, Rebecca Faith Lange, consent to the use and registration of my name, REBECCA FAITH, as a trademark and/or service mark with the USPTO.”
