Dear Mr. Platt,

 

I am reviewing the referenced application.   I am happy to report that I found no conflicting marks.  However, there are a couple issues I am hoping that we may quickly resolve by Examiner’s Amendment.

 

Identification of Goods

 

Some of the wording in the identification of goods/services is indefinite and must be clarified and properly classified.  In this regard, “preparations for  … protecting, and preserving surfaces” and “agents for … polishing, protecting, and preserving surfaces” are indefinite.  To ensure proper classification, applicant must further clarify their nature.  In this regard, please note that some agents such as chemical agents are in Class 1.  For example, “agents for cleaning and preserving surfaces for industrial purposes, namely chemical preparations being degreasing solvents” would be in Class 1.

 

Applicant may substitute the following wording (and fill in the blank), if accurate.

 

Preparations and agents for cleaning and polishing surfaces; Preparations and agents for protecting and preserving surfaces, namely, _________ [specify nature or common commercial name(s), e.g., leather preserving polishes, floor wax], in Class 3. 

 

Disclaimer

 

A disclaimer of “CHEMICAL COMPOUNDS” is necessary because it appears to describe a feature/ingredient of the goods, which presumably include those with chemicals therein (see definitions here: http://www.britannica.com/science/chemical-compound and http://www.lexico.com/en/definition/compound#compound )

 

If a disclaimer and amendment to the identification are acceptable to applicant, I would be happy to issue an Examiner’s Amendment to quickly resolve the matter.  Please note that I must take action in the next couple days.
