Applicant must clarify the wording as set forth below because it is indefinite and too broad.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  International Class 028: Toys, games and playthings; Gaming devices; Mobile gaming devices; and Portable gaming devices is indefinite because the wording does not (1) specify the type of toys, games and playthings, {e.g., stuffed toys, pet toys, board games, and playthings, namely, puppet theatres, etc.}, or the type of gaming devices, {e.g., gaming machines, slot machines, slot machines, bingo machines, with or without video ouput}; Gaming peripherals, namely, {specify the peripherals, e.g., game controllers, joysticks, etc.}; Virtual reality headsets adapted for use in playing augmented reality video games; and Virtual reality headsets and helmets adapted for use in playing video games” must be reclassified to International Class 009. [Under Nice 11-2017, “virtual reality headsets” are classified in International Class 009 regardless of their purpose.].

The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Sections 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
