To the Commissioner for Trademarks:

Application serial no. 88496070 FLC THE FINE LIGHTING CO. (Stylized and/or with Design, see http://uspto.report/TM/88496070/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examining Attorney raised pending applications for FLC THE FINE LIGHTING COMPANY, Ser. No. 86898468 and  FLC THE FINE LIGHTING CO., Ser. No. 86898469 (the "Cited Applications") as potential barriers to registration of Applicant's mark.  The Cited Applications are now abandoned.  Nevertheless, Applicant is the owner of the Cited Applications.  Through a trademark assignment agreement effective as of June 6, 2019, Techtronic Power Tools Technology Limited conveyed, transferred and assigned all right, title and interest in and to the FLC THE FINE LIGHTING COMPANY, Ser. No. 86898468 and FLC THE FINE LIGHTING CO., Ser. No. 86898469 trademarks, together with the goodwill of the business connected with the use of, and symbolized by, the assigned trademark, to Techtronic Cordless GP. As Techtronic Cordless GP was the effective owner of the Cited Applications at the time of filing the subject application, Applicant requests that the potential suspension based on the Cited Applications be withdrawn and that the application be approved for publication.
