ARGUMENT(S)

Section 2(e) (2) Refusal – Primarily Geographically Descriptive

The Office Action indicates registration is initially refused because the Examining Attorney believes the applied-for mark is primarily geographically descriptive of the origin of applicant’s goods because the first term “L.A.” is an abbreviation for “Los Angeles”.

Applicant respectfully disagrees that the mark is primarily geographically descriptive. Moreover, Applicant believes that the “L.A. COLORS” portion of the mark has acquired distinctiveness of Applicant’s goods through Applicant’s substantially exclusive and continuous use of the mark in commerce for at least twenty years. Applicant has amended the application to add a claim of acquired distinctiveness as to “L.A. COLORS”. Applicant’s “L.A. COLORS” trademark is also registered on the Principal Register (Registration No. 5442511). Concerning the terms “ULTIMATE” and “COVER”, Applicant is submitting herewith a disclaimer to address the Examining Attorney’s point that these two words are descriptive or laudatory.

CONCLUSION

In light of the amendments and remarks set forth above, Applicant has addressed all of the issues raised in the Office Action and respectfully submits that the application is ready for publication. In the event the Examining Attorney has any additional questions, the Examining Attorney is invited to contact the undersigned.
