Dear Mr. Shires and Mr. Schmidt,
I am writing regarding your trademark application for "Tattoo Wrap" (Serial No. 88495177). There are a few issues in the application, and I am hoping we can resolve them via email or phone. They are:
1. Disclaimer - The wording “Tattoo Wrap” is descriptive of the goods, being an adhesive bandage, or wrap, that goes over a tattoo, and it needs to be disclaimed. (Please note: The disclaimer does not change how the mark appears in the mark, but is a statement printed on the registration stating that the applicant does not claim exclusive rights to use this wording apart from how it appears in the mark.)
2. Entity Information – In the application, your individual names appear in the Owner Information section, but each of your entity types is listed as being a limited liability company. Please clarify whether you own the mark as individual joint applicants, or whether there is an LLC, e.g. Tattoo Wrap, that owns the mark. If joint applicants, then please provide the country of citizenship for each individual.
3. Description of the Mark – The wording “our product” in the mark description does not accurately describe what the drawing of the mark looks like. I am suggesting that the mark descriptive be amended to the following:
The mark consists of a wavy design resembling a piece of cloth with the words “Tattoo Wrap” printed on it. It has a design indicating that it is being bent up in the bottom right corner. With a lower piece like a second page underneath partially showing two edges with designs of a heart with a dagger through it, part of an anchor, a rose, and parts of stars.
Please let me know if I may enter these 3 changes for you with an Examiner’s Amendment.
As joint applicants, both of you would need to respond to/sign the response to this email in order to authorize the changes.
