ARGUMENT(S) |
In response to Section 2d Refusal, I would like to argue that three examples of Registered Trademarks were given as examples that contain the word
Jaden in some form of spelling or similar phonetic sound. The very fact that these three trademarks exist containing a word that can be pronounced the same but have slight variation in spelling and
also contain similar goods/services, is the main argument as to why JADEN (in stylized text) should be accepted as a trademark and coexist with out causing likelihood of confusion. These three
examples have the same goods in some categories yet they are registered trademarks and have not had the issue of confusion amongst their consumers. They also have the same word with slightly
different spelling, that sound the same phonetically, yet they have all been accepted as trademarks. JADEN along with the stylized font, specific spelling, and designs being sold to consumers, will
not cause confusion or mislead customers into thinking it is another brand and should be able to coexist because the mark does not look similar to any other trademarks in appearance. In Response to
Font Stylization, the mark is in special form format. The mark is spelled JADEN in all capital letters, containing a specialized and specific font. It is not in standard characters. |
