Good morning. I am the trademark examining attorney reviewing several of Jinfiniti’s applications. Before I can approve the following applications for publication, there are some amendments that are necessary. Please see below.
· SN 88479178, SPOTTUMOR
In this application, the identification of services is indefinite and must be clarified because the nature of the services is uncertain. I propose the following, if accurate (proposed amendments in bold):
Class 44: providing cancer screening services; medical analysis services for early cancer diagnosis and early detection of cancer recurrence; medical testing for treatment purposes, namely, therapeutic monitoring of cancer treatments
· SN 88480746, CUPID
In this application, the we just need to clarify the identification a bit to ensure proper classification. For classification in Class 44, the services must be for medical purposes. If the services are for research purposes, they are classified in Class 42. I propose the following in Class 44, if accurate (proposed amendment in bold):
Class 44: Genetic and genomic testing for medical purposes, namely, for cancer diagnosis and prognosis
If the above amendments are acceptable, I can enter them via Examiner’s Amendments and then I should be able to approve the applications for publication. I would appreciate a response as soon as possible, but not later than the close of business on Thursday, September 19.
