I just realized when doing my final review before sending this Examiner’s Amendment the application currently has a 1(b) and 44(d) filing basis. If the applicant intends to rely on a Section 44 filing basis I will need to suspend the file after Examiner’s Amendment pending receipt of the foreign registration. However, if the applicant intends to rely only on the Section 1(b) filing basis, I can remove the Section 44 basis via Examiner’s Amendment and publish this one.
