In regards to the above-captioned trademark applications, I need an amended mark description. This is the only issue in all three applications, and I can take care of it my Examiner’s Amendment if so authorized.
You mention that the design features a “solid black arch”, but generally, color cannot be mentioned in a mark description with no accompanying color claim; additionally, color cannot be claimed in marks depicted in grayscale (i.e., black, white, and gray) on the drawing of record.
Here is my proposed mark description: The mark consists of a stylized, generally unshaded block letter “T”, which is broken apart by a solid shaded arch design.
Please review and advise whether I can make the change by Examiner’s Amendment in all three files. If I don’t hear back by the end of the day, I will send an Office action, but you can always reach out by phone or email to take care of the requirement by Examiner’s Amendment and expedite approval of your marks.
