Subject: RE: Trademark Application SN 88473816, MUSIC FOR SCREENS
Dear Mr. LaVine,
I am following up on the below email since I haven’t received a response. I did want to let you know that we have received additional guidance regarding the U.S. counsel rule, and since you entered an appearance before August 3, 2019, we do not have to enter your bar information into the record. So at this point, the only issue that needs to be resolved is the minor amendment to the identification as discussed below and in the Office action. If the amendment is acceptable, please let me know and I will issue an Examiner’s Amendment so we can keep this application moving for your client.
Please let me know if you have any questions.
Thanks,
Melissa

Dear Mr. LaVine,
Good morning. I have reviewed your response to the Office Action and, while the Section 2(e)(1) refusal has been overcome by the amendment to the Supplemental Register, there also was a requirement in the Office Action to amend the identification slightly for clarification, as follows (proposed amendment in bold):
Class 41: Educational and entertainment services, namely, conducting conferences, workshops, panel discussions, seminars and classes in the field of creating, producing, and recording music in the television and movie industries and the distribution of course material therewith
If this is acceptable, please let me know and I can amend via Examiner’s Amendment.
Additionally, due to the new U.S. Counsel rules that went into effect on August 3, 2019, you must provide your bar membership number, the name of the U.S. jurisdiction of your bar membership, and the year you were admitted, and the following attestation is required: “I attest that I am an attorney who is an active member in good standing of the bar of the highest court of a U.S. state (including the District of Columbia and any U.S. Commonwealth or territory).” http://www.gov.uspto.report/trademark/laws-regulations/trademark-rule-requires-foreign-applicants-and-registrants-have-us
The bar information and attestation can be added via Examiner’s Amendment, as neither require a verification signature. In the Examiner’s Amendment, I will just state that the bar information and attestation were provided; I will not put your bar information in the Examiner’s Amendment. Additionally, if provided via email, I will redact your bar information prior to placing the email in the record.
If the above ID amendment is acceptable, please also provide your bar information and I will issue an Examiner’s Amendment. Then the application should be ready to approve. I would appreciate a response as soon as possible but not later than the close of business on Wednesday, August 14, 2019.
If you have any questions, please feel free to contact me.
Sincerely,
/Melissa S. Winter/
