TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.  

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

NO LIKELIHOOD OF CONFUSION

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

SUMMARY OF ISSUES:

 

  • Advisory re: partial refusal:  as to all classes except International Class 35, registration may be refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the goods/services in other international classes

ADVISORY RE: PARTIAL REFUSAL:  AS TO ALL CLASSES EXCEPT INTERNATIONAL CLASS 35, REGISTRATION MAY BE REFUSED BECAUSE THE SPECIMEN DOES NOT SHOW THE APPLIED-FOR MARK IN USE IN COMMERCE IN CONNECTION WITH ANY OF THE GOODS/SERVICES IN OTHER INTERNATIONAL CLASSES

 

As to all of the goods/services in international classes other than International Class 35, registration may be refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the goods and/or services specified that may be classified in other International Classes, e.g., classes 9, 11, 42, etc., in the application.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); In re Keep A Breast Found., 123 USPQ2d 1869, 1876-79 (TTAB 2017); In re Graystone Consulting Assocs., Inc., 115 USPQ2d 2035, 2037-38 (TTAB 2015); TMEP §§904, 904.07(a), 1301.04(d), (g)(i).  Specifically, while the specimen may show use of the proposed mark in connection with various dispensing-related services in International Class 35, it does not show use of the mark with the goods/services that would be classified in other international classes.

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods and/or services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale.  See TMEP §§904.03 et seq.  Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods.  TMEP §904.03(i).  Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §1301.04(a), (h)(iv)(C).  Specimens comprising advertising and promotional materials must show a direct association between the mark and the services.  TMEP §1301.04(f)(ii).

 

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

 

(1)       Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the goods and/or services identified in the application or amendment to allege use.  A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20:  “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.”  The substitute specimen cannot be accepted without this statement.

 

(2)       Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

In addition to the above advisory, please note the following requirements to which the applicant must respond. 

 

REQUIREMENTS

 

REQUIREMENT THAT APPLICANT AMEND THE IDENTIFICATION OF GOODS/SERVICES

 

“The purpose of the identification of goods [and/or services] is to provide the general population, including consumers and members of the relevant industry, with an understandable description of the goods and services, which is done by using the common commercial name for the goods [and/or services].”  In re Gulf Coast Nutritionals, Inc., 106 USPQ2d 1243, 1247 (TTAB 2013) (citing In re Sones, 590 F.3d 1282, 1289, 93 USPQ2d 1118, 1124 (Fed. Cir. 2009)).  If there is no common, ordinary name for the goods and/or services, applicant should describe the goods and/or services using wording that would be generally understood by the average person.  See Schenley Indus., Inc. v. Battistoni, 112 USPQ 485, 486 (Comm’r Pats. 1957); Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954); TMEP §1402.01.

 

An in depth knowledge of the relevant field should not be necessary for understanding a description of the goods and/or services.  TMEP §1402.01.  “[T]echnical, high-sounding verbiage” should be avoided.  Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ at 322.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

 

The applicant has applied to register the mark for:

 

IC 35:  Customer support services, namely, providing initial setup support, continual optimization support and consultation, and on-going subscription-based beverage shipments in the fields of refrigerated beverage dispensing units, refrigerated dispensing units for beverages, and temperature-controlled food and beverage dispensers; Refrigerated beverage dispensing units; Refrigerated dispensing units for beverages; Temperature-controlled food and beverage dispensers; Software to show in-depth data in the fields of Refrigerated beverage dispensing units, Refrigerated dispensing units for beverages, Temperature-controlled food and beverage dispensers

 

The identification for software in International Class 35 is indefinite and too broad and must be clarified because the wording does not make clear the (1) nature or (2) format of the software and could identify goods and/or services in three international classes – as a product in International Class 9 or a service in International Class 41 or 42.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.03(d), 1402.11(a).  Specifically, applicant must indicate the purpose or function of the software, and if content- or field-specific, the content or field of use of the software.  TMEP §1402.03(d).  Additionally, applicant must indicate whether the software’s format is downloadable, recorded, or online non-downloadable.  See id.  Downloadable and recorded goods are in International Class 9, whereas providing their temporary, online non-downloadable use is a service in International Class 42; except for non-downloadable game software provided online or for temporary use, which is classified in International Class 41.  See TMEP §§1402.03(d), 1402.11(a)(xii).

 

The USPTO requires such specificity in order for a trademark examining attorney to examine the application properly and make appropriate decisions concerning possible conflicts between the applicant’s mark and other marks.  See In re N.A.D. Inc., 57 USPQ2d 1872, 1874 (TTAB 2000); TMEP §1402.03(d). 

 

The following are examples of acceptable identifications in International Class 9:  “recorded desktop publishing software” and “downloadable mobile applications for managing bank accounts.”  Additionally, the following are acceptable identifications in International Class 41:  “providing online non-downloadable game software” and “providing temporary use of non-downloadable game software.”  Finally, the following are acceptable identifications in International Class 42:  “providing temporary use of on-line non-downloadable software development tools” and “providing temporary use of non-downloadable cloud-based software for calculating energy costs.”

 

In addition, the wording “consultation” in International Class 35 must be clarified because it is indefinite and too broad.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03, 1402.11(e).  This wording is indefinite because it does not specify the subject matter of the services.  Further, this wording could identify services in more than one international class.  

 

Consulting services are classified according to the subject matter of the consulting service; for example, “business management consultancy” is classified in International Class 35 and “computer technology consultancy” is classified in International Class 42.  TMEP §1402.11(e). 

 

Applicant may adopt the following wording, if accurate:

 

IC 9:  [Clarify “Software to show in-depth data in the fields of Refrigerated beverage dispensing units, Refrigerated dispensing units for beverages, Temperature-controlled food and beverage dispensers” to show whether the software is downloadable or recorded on media such as compact discs and to clarify the function of the software, e.g., downloadable computer software to display [clarify “in-depth data”] collected from refrigerated beverage dispensing units, refrigerated dispensing units for beverages, temperature-controlled food and beverage dispensers]

 

IC 11:  Refrigerated beverage dispensing units; Refrigerated dispensing units for beverages; Temperature-controlled food and beverage dispensers

 

IC 35:  Customer support services, namely, [clarify “providing initial setup support”], [clarify “continual optimization support and consultation”, e.g. consultation in the field of business management of refrigerated beverage dispensing units, refrigerated dispensing units for beverages and temperature-controlled food and beverage dispensers], and on-going subscription-based beverage shipments in the fields of refrigerated beverage dispensing units, refrigerated dispensing units for beverages, and temperature-controlled food and beverage dispensers

 

IC 42: [Clarify “Software to show in-depth data in the fields of Refrigerated beverage dispensing units, Refrigerated dispensing units for beverages, Temperature-controlled food and beverage dispensers” to indicate that the software is provided as service, if accurate, and clarify the function of the software, e.g., providing temporary use of on-line, non-downloadable computer software to display [clarify “in-depth data”] collected from refrigerated beverage dispensing units, refrigerated dispensing units for beverages, temperature-controlled food and beverage dispensers]; providing initial setup support in the nature of technical support services, namely, troubleshooting of computer software problems related to software in refrigerated beverage dispensing units, refrigerated dispensing units for beverages, and temperature-controlled food and beverage dispensers

REQUIREMENT THAT APPLICANT COMPLY WITH ALL MULTI-CLASS APPLICATION REQUIREMENTS

 

The application references goods and/or services based on use in commerce in more than one international class; therefore, applicant must satisfy all the requirements below for each international class:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  Specifically, the application identifies goods and/or services based on use in commerce that are classified in at least 4 classes; however, applicant submitted a fee(s) sufficient for only 1 class.  Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

 

(3)       Submit verified dates of first use of the mark anywhere and in commerce for each international class.  See more information about verified dates of use.

 

(4)       Submit a specimen for each international class.  The current specimen is acceptable for class 35; and, depending on how applicant chooses to amend its identification of goods/services, applicant may need specimens for as many as three additional classes, i.e., International Classes 9, 11 and 42, if not more.   See more information about specimens.

 

            Examples of specimens for goods include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale.  Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. 

 

            Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services. 

 

(5)       Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.  See more information about verification.

INFORMATION REQUIREMENT

 

To permit proper examination of the application, applicant must explain whether the letters in the mark “DAAS” have any significance in the customer services, beverage dispensing or software trade or industry or as applied to applicant’s goods and/or services, or if such letters represent a “term of art” within applicant’s industry.  See 37 C.F.R. §2.61(b); TMEP §814.  Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.

 

It appears from applicant’s specimen that it is using DAAS to mean “dispensing as a service.”  It this acronym commonly used in the service industry?  Also, it appears from the attached evidence from http://www.acronymfinder.com/DAAS.html, downloaded on 9/7/19, that DAAS is also a common acronym for data as a service, data acquisition and analysis, desktop as a service, etc.  Do any of these acronyms have any meaning in the relevant trade or industry or as applied to applicant’s services?
