Hello again, Mr. Weiss.  I discussed the issues with Cristiana, my senior attorney, and upon further consideration, since your client has agreed to delete the cited goods, we are okay with removing LA ZONA SUPERMARKET as a potential bar to registration.  If your client approves of the changes detailed below, I will issue an Examiner’s Amendment that will delete the cited goods.  The revised amendment will read as follows:

 

*Class 29:  fish-based spread; pickle-based spread; mushroom-based spread; tomato-based spread

 

Class 30:  Brine for cooking; brine for preserving fish and vegetables; spices; salt; flavored salt; dried herbs; processed herbs; vinegar; savory sauces used as condiments

 

*Please note that I inadvertently failed to include “food spreads” in the Section 2(d) refusal, however, these goods are also related to the goods in the cited registration(s) because “food spreads” could include things like jam, etc.  As a result  I have deleted the wording from Class 29.

The EA will also include following translation of the wording “ZONA”:

 

The English translation of “ZONA” is “ZONE”.
