It appears the cited prior-pending application is now DEAD on the record. However, upon further review, there is one requirement I omitted from my first Office action. Apologies for not noticing this issue in the first Office action and any delays it may have caused.
The mark description must be amended to include all the design aspects of your mark. I suggest the following wording below:
“The mark consists of the wording “LOCAL MINI DONUT COMPANY” in stylized font inside a circle carrier with a ring of stars around the inside border of the circle, all superimposed over a shaded circle with textured edges.”
If you agree to the mark description above, I can make the changes for you via an Examiner’s Amendment. Alternatively, I can issue you a new non-final Office action, detailing the requirements above.
