Subject: U.S. Trademark Application No. 88455179 -- PASSHUB

Dear Maxim:

I am the attorney from the United States Patent and Trademark Office assigned to examine the above-referenced U.S. Trademark Application.

I have searched the Office’s database of registered and pending marks and have found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).  However, the identification of goods and services must be amended before I can approve the mark for publication, and I suggest the following amendments:

Class 9:                Downloadable computer application for mobile phones, namely, software for use in storing, sharing and managing confidential information in the nature of passwords, credit card information, confidential files, secret data and access keys; downloadable computer software for use in storing, sharing and managing confidential information in the nature of passwords, credit card information, confidential files, secret data and access keys; downloadable computer software for use in data security, namely, securing data, networks, computers, personal computing devices, and mobile devices from cyberattacks; downloadable computer software for enabling the secure access, control, viewing, and utilizing of data via personal computing devices and networks; downloadable computer software for management of usernames and passwords for use with computer devices, systems, and software; downloadable identification and authentication security software, namely, software for identifying and authenticating users of personal computing devices, computers, mobile devices, and communication networks

Class 42:              Computer security and internet security consultancy services; computer security and internet safety consultancy services relating to data security; electronic data storage; software as a service (saas) featuring software for use in storing, sharing and managing confidential information in the nature of passwords, confidential files, secret data and access keys; design, update, maintenance and rental of non-downloadable and cloud based software to enhance security of data and information on networks, computers, personal computing devices, and mobile devices; design, update, maintenance and rental of non-downloadable and cloud based software to enhance security of identity and personal information on networks, computers, personal computing devices, and mobile devices; data encryption services, namelty, computer data encryption and data proxy services in the nature of server hosting for use in securing, monitoring, authenticating and identifying individuals using computer devices, systems, and software; data encryption and decoding services

With your authorization, I can enter the amendment(s) myself by Examiner’s Amendment.  Entering the amendment(s) in this manner would eliminate the need for issuance of a formal Office Action and for filing a formal Response.

If you get a chance to respond before 6 pm ET on Wednesday, August 28, you can authorize proposed Examiner’s Amendment by return email or by calling me at the number below.  If I do not hear from you by then, I will issue a formal Office Action and you will have six months to respond.

If I can answer any questions or be of any assistance, please do not hesitate to contact me.

Best regards,

Matt
