for SUPERSOFT & Design. Submitted herewith is a copy of the Consent to Use and Register Agreement subsequently signed by the Applicant and Kittrich Corporation, the owner of record of U.S.
trademark registration no. 4,769,953 for ASHLEY SUPER SOFT that was cited in the September 3, 2019 Office Action against Applicant's application. Subsequent to the filing of Applicant's response,
Kittrich advised Applicant's undersigned attorney that it is currently using the ASHLEY SUPER SOFT mark. As set forth in the Agreement, the Applicant and Kittrich, who are both participants in the
relevant industry, having considered their long time co-existence in the marketplace, agree that there has been no confusion between their respective marks thus far, and do not expect there to be
confusion, and that they will take steps to prevent and/or remedy any confusion, should it occur in the future. Therefore, Applicant requests withdrawal of the refusal under Trademark Act Section
2(d) as well as the disclaimer requirement. |
